Summary/Abstract: International air carriers protested against the extension of the EU Emission TradingScheme to aviation activities that entered into force in 2012. The High Court of Justice forEngland and Wales made a reference for a preliminary ruling to the Court of Justice of theEU asking about the validity of Directive 2008/101 in the light of the customary principles of international law and the international agreements, mainly the Chicago Convention, the Kyoto Protocol and the so-called Open Skies Agreement between the EU and the USA.The case C-366/10 featured strong economic and political interests. From a legal perspective it tackles the problem of direct effect, the validity of Union acts and the love-hate relationship between the EU and international law.
