Summary/Abstract: Collective bargaining constituted even from the early twentieth century the cornerstone of labor law. Indeed, labor law is "cellular" linked to collective bargaining, because the brand of the labor law’s identity is collective bargaining, social dialogue, specifically what we call "collective labor law". However, one by one, globalization, digitalization, fragmentation of labour market, competitive relations between workers, the pressure exercised by the consumers, the image’ deficiencies significantly felt by the unions (traditional exponents of employees in collective bargaining), the dissolution of solidarity between workers at the national level, but also at the European level - led to an unsettling contraction (collapse) of the collective bargaining. It's not that it would not be useful, as useful as ever for employees, but about the fact that certain social developments may have obstructive effects on collective bargaining. Besides, diminishing collective bargaining could jeopardize the very branch of labor law as a whole. This study seeks to set out the main causes of the current realities of collective labor relations, and a collective bargaining contemporary diagnosis – both at the national level and at the European level.
