Summary/Abstract: In this paper, the author deals with the institute of acquiring property rights from non-owners, illuminating it from the positions of internal rights, as well as a comparative legal review, with the distinction of continental and aglo-Saxon law, because, besides the same idea, there are certain differences. In the law that emerged after the dissolution of the SFRY, almost the same solutions exist, both in terms of both general and special conditions.
