Summary/Abstract: The Arbitral Committee established by the European Community in the framework of the Conference on Yugoslavia, issued on 7 December, 1991, its »Opinion No. 1«. In this paper are discussed and commented statements from this Opinions, the most important of which is »that the Socialist Federal Republic of Yugoslavia is in the process of dissolution«. All these general statements are mutatis mutandis applicable to the Union of Soviet Socialist Republics. This author disputes arguments advanced by Serbia, either in this Arbitral procedure, or at the Hague Peace Conference. Slobodan Milošević, the president of Serbia, has personally had a decisive role in the choice of legal arguments of Serbia.
