CRIME ROBBERY – CRIMINAL LAW AND COMPARATIVE ASPECT

Summary/Abstract: The crime of robbery in recent years manifest all three elements of contemporary crime (organized and belongs to a group of violent and property crime). It is a criminal act that, according to object of protection, can be systematized in a group of property crimes, but by the ways and means of taking action of execution in group of violent crimes. The crime of robbery consists in the seizure of another’s movable property using force or threats to his life and body with the intention of appropriating illegal gain. The concept of the crime points to the characteristics of which are reflected in: object of act, object of protection, the type of execution act, means of undertaking the action. The crime of robbery is present in all foreign jurisdictions, including in countries which were located within the former Yugoslavia. Other countries provide the same forms of manifestation of the crime of robbery as well as our legislation. The differences are mostly insignificant, primarily in regard to criminal sanctions. The social threat of criminal offenses of robbery is high and consists in the fact that they attack the property, physical integrity, freedom of man as a social good in general. However, it social threat is not just reflected in mentioned, some forms of robbery because of its characteristics (number, means, method, time) significantly affect the intensity, degree and extent of social danger. As a particular danger for the last period of time, by which these acts are gaining its weight, is an increasing number of minors and young adult persons that occur as the offenders. Based on the statistical data we can conclude that the crime of robbery is on the rise, as well as level of violence manifested in the execution.
