Summary/Abstract: In the Polish legal doctrine, the notion of concession (licence) is most often associated with administrative decision-making, following the Act of 2 July 2004 on the Freedom of Economic Activity. Concession (licence), in this sense, is a legal form of limiting economic activity. Concessions (licences) governed by this law do not include the concession (licence) regulated in the Act of 9 January 2009 on concessions (licences) for construction works or services, which is based on the concept of an agreement (a concession agreement) concluded between administrative authorities and entrepreneurs for construction works or services. Legal literature presents various opinions on the nature of the concession (licence) agreement. Some authors advocate for its public law nature, while others trace it to civil law. The article discusses the problem of the legal nature of concession (licence) agreement and indicates its duality, being simultaneously a civil law agreement and a public law agreement, and therefore located on the border of private and public commercial law.
