Guarantees of the Treasury

Summary/Abstract: One of the instruments of public finances are sureties and guarantees of the Treasury. These are applied to the monetary obligations of various entities. Their greatest impact is on the process of obtaining large investment loans and financing economic purposes. Sureties and guarantees were initially derived from private law. They have been successfully applied in the area of public law. The paper describes the rules for the granting and the repayment of Treasury sureties and guarantees. It further describes entities representing the State in terms of sureties and guarantees, the legal basis for the use of such instruments, the subject of warranties and guarantees, commissions and the issue of securing claims arising from the performance of the duties of the surety or guarantor. The paper also presents statistics about the size of sureties and guarantees of the Treasury for the years 2004–2012. Final conclusions are also included.
