Summary/Abstract: What are the international legal norms regulating situation of asylum-seekers and other migrants travelling by sea? What is the legal framework for international operations addressing the migrant crisis, such as recent activities of NATO in the Aegean Sea? This article shows that with diverse factors coming into play, too narrow legal perspective can be an easy mistake. It provides a comprehensive overview of applicable norms of law of the sea; rules concerning search and rescue; refugee’s rights; human rights and human trafficking laws. It also aims to serve as a reference to useful international documents, case-law and literature, indicating a clear way forward in need for even further research. After reading this paper, you will know what are the main legal challenges for States trying to implement a systematic approach. You will also get closer to grasping the constraints of legal solutions as means of addressing the migrant crisis.
