Summary/Abstract: The judiciary is a crucial partner in the development, interpretation, implementation, and enforcement of environmental law and policy - particularly, the development and actualization of the broad national goals of environmental governance and sustainable development through balancing environmental, social, economic and developmental choices in its judicial decision making process in both Nigeria and India. This paper reviews the techniques employed by the Courts in selected cases in their decision making process aimed at maintaining their countries commitment to the sensitivity of the environment and the need to deepen environmental governance in an era of climate peril.
