Summary/Abstract: The objective of this article is to attempt to define the notion of source of civil law, to determine the conditions that such a source must meet and, of course, to attempt to answer to the question asked in the title of the article. Also, in the article, we presented the reasons why it is necessary to solve this legal issue and the possible consequences that may occur as a result of improperly solving the mentioned issue. In writing the article, we took into account the conclusions expressed in the specialized doctrine, which were subject to analysis in relation to the applicable legal provisions.
