THE CONSUMER’S RIGHT TO WITHDRAW FROM DISTANCE SALES CONTRACTS VIA THE INTERNET

Summary/Abstract: This paper discusses consumer rights concerning the abandonment of the contract of distance sale via the Internet. In order to harmonize their legislations with the European Union law, the Republic of Serbia and the former Yugoslav republics have either passed new legislative acts on consumer protection or amended the outdated ones. In particular, the legislation had to comply with the Directive on Consumer Rights 2011/83/EU. In this article, the author discusses cases where the consumer has the right to withdraw from a contract, particularly focusing on the manner of exercising this right and calculating the time limits for withdrawal, how the withdrawal affects co-related contracts, and examining the exceptions to the right of withdrawal from a contract. In writing this paper, the author used the legal, historical and comparative methods. The aim is to examine whether the legal solutions contained in the new Consumer Protection Act of the Republic of Serbia are in compliance with the Directive on Consumer Rights 2011/83/ EU.
