DEFERMENT AND INTERRUPTION AND TIME LIMITATION ON ENFORCEMENT OF IMPRISONMENT

Summary/Abstract: An enforcement of imprisonment in the same or other case suspends the running of the limitation period. Due to the Executive Penal Code is possible, to respite the enforcement of penalty or give a convict an interruption in her serving. In the period of deferment or interruption the sentence is not enforced. Ergo, during deferment or interruption of enforcement of imprisonment the term of the limitation is running. The author judges the present regulation. As a conclusion she proposes an amendment to the Code and makes a demand de lege ferenda.
