Summary/Abstract: The problems connected with the personality,s necessity of the defense in the process of entrenchment upon his or her sexual freedom and sexual immunity are analyzed in the article. Persons who are entrenched upon their sexual freedom or sexual immunity realize their natural right for self-defense. The author of the article proposes to accept as valid the defense of less useful benefit instead of the damage to more useful benefit on the legislative level. It is proposed to change part 5 of the article 36 of the Criminal Code.
