Summary/Abstract: This topic proposed for discussion in this paper requires a thorough analysis in the doctrinal, methodological and practical way, starting from the fact that the reality of nowadays confronts the theoreticians and practitioners with an essential and controversial problem, namely a scientific argumentation of the necessity and ways of limiting human rights and fundamental freedoms by invoking the common good. One of the problems that humanity has to unleash is the realization of a civil society that manages fairly and harmoniously the right, to restrict the freedom of the individual for the freedom of the fellow, to promote and respect the fundamental human rights, but at the same time, to watch the development of humanity by promoting the common good concept.
