CONSIDERAŢII ASUPRA DURATEI, TRANSMITERII ŞI ÎNCETĂRII DREPTURILOR NĂSCUTE DIN TOPOGRAFIILE PRODUSELOR SEMICONDUCTOARE
Considerations about the duration, the transmission and ending rights arising out of topographies of semiconductor products

Summary/Abstract: This paper joins the recent analyses in the literature aiming at the examination of the regulations regarding the topographies of the semiconductor products. The authors present some critical remarks on the norms included in the Law no. 16/1995 concerning the legal protection of the topographies of the semiconductor products, especially the duration, transmission and termination of the rights emerged from these industrial creations. Also, the study highlights the lack of correlation between the provisions of the special Law, on the one hand, and the norms in the new Civil Code (Law no. 287/2009) and in the new Code of Civil Procedure (Legea nr. 134/2010), on the other hand. Eventually, the authors formulate de lege ferenda proposals, in the view of eliminating the identified legislative deficiencies in the researched field.
