Summary/Abstract: In the process of European integration human rights protection has become one of the most prominent values. Nevertheless, the application of standards derived from the European Convention on Human Rights (ECHR) and from case law of the European Court on Human Rights still meets some obstacles at a national level. This article examines the legal nature of the foundation for the application of ECHR in Germany, especially Art. 1 para. 2 of the German Basic Law, but mostly focuses on the application of ECHR from the point of view of the German Constitutional Court.
