THE REFERENDAL NATURE OF THE ACT WHICH LEGITIMISES POLAND’S ACCESSION TO THE EUROPEAN UNION

Summary/Abstract: This essay is focused on one of the democratic procedures aimed at legitimising the decision in an issue of institutional law, which was expressing assent to the ratification of the international agreement, due to which the Republic of Poland has transferred competence of the state organs in certain subject-matters to the European Union. Issues that are included in this text are related to the legal terms such as: legitimisation and its contemporary legal sources (elections and other procedures of public voting and direct participation of citizens in procedure of wielding power). The Author concentrates mainly on the procedure of referendum, which in polish system can be treated as a mechanism allowing Poland to access the European Union. At this point, it was important to establish the actual subject of public voting, its character and results. Searching for the answer to the question regarding the scope of being bound by the will having been expressed directly by citizens in the referendum vote which took place between 7– 8 June 2003, leads to the conclusions regarding the institutional legal consequences, related to the necessity of accepting future integration arrangements.
