Condictio sine causa in B&H Legal system

Summary/Abstract: The article is dealing with condictio sine causa. Unjust enrichment exists when one person’s estate is increased unjustifiably at the expense of another. Condictiones sine causa has had a long tradition in European civil law as one of the most efficient legal remedies for unjust enrichment. The author of the text considers general enrichment action, wide spectrum of different types of condictio and deals with some particular types of condictiones sine causa applied to various cases of unjust enrichment. The author analyzes the application of this institute in the court practice of Bosnia and Herzegovina and gives opinion on the draft of law on obligations of The Republic of Srpska and Federation of Bosnia and Herzegovina.
