Summary/Abstract: On 28 April 2016 the Directive (EU) 2016/681 of the European Parliamentand of the Council on the use of passenger name record (PNR) data for the prevention, detection, investigation and prosecution of terroristoffences and serious crime was adopted by the 28 Member States. Regulating this complex issue, European legislator has been obliged to strike a “fair balance” between the objective of combating terrorism and serious crime and the objective of protecting personal data and respecting the private life of the passengers. The aim of this paper is to analyse the provisions which apply to the processing of PNR data in the light of the principle of proportionality.
