Some issues concerning the regulation of the procedure for challenging the insurance measure or the way of bringing it to its fulfillment in the new Penal Procedure Code

Summary/Abstract: The present study aims to analyze the regulation of criminal proceedings instituted in the matter of precautionary seizures, with the entry into force, on the 1st of February 2014, of the new Code of Criminal Procedure, as regards the activity of the judge of rights and liberties, the preliminary chamber judge and the court. It aims not only to present the gaps, contradictions and inconsistencies of the new legislation, but also to provide solutions to the identified problems, either by means of interpreting the existing law or by putting forward de lege ferenda proposals.
