Considerations on the substantive conditions of the process of adoption in the regulation of the new Civil Code

Summary/Abstract: Along with the entry into force of the new Civil Code, it is offered a different perspective on the process of adoption, which fulfils an important social and family role, by ensuring that the adoptee it is offered an appropriate protection in an adequate environment at home.The present paper aims to inform the readers about certain aspects regarding the substantive conditions of the process of adoption, in accordance with the provisions of the new Civil Code and of Law no. 273/2004. For this purpose, the article highlights all the legal requirements that must be met by the people involved in the process of adoption, so that it is considered valid, as well as the sanction that is to be imposed if the provisions are not met.
