Summary/Abstract: This work aims to underline the differences between the continental law system and the Common Law, in a manner that presents the essence itself of the two legal worlds, which are destined to be separate. It points out the absence of the need to transfer the majority of judicial notions from one system to another and shows they are really opposite. We cannot have a fair justification for legal transplant, because we simply cannot identify identical cultures and identical moral foundations in the judicial and social history.
