Selected Issues Concerning Personal Data Processing in the Local Government

Summary/Abstract: The article includes deliberations about the optimal form of a personal data protection system in the local government administration’s activities. The local authorities collect and process citizens’ personal data under their statutory mandate, correlating with such individuals’ obligation to disclose such data. Personal data processing is an interference in a person’s information autonomy, which is why any events thereof should be clearly defined. In practice, there are difficulties emerging as regards, amongst other things, the correct identification of a local government data administrator, the appointment of an information security administrator, or personal data processing conditions. From the referenced deliberations, it appears that the boundaries of personal data processing in the local government administration are delineated by the law and justified on the grounds of the requirements set for civil service in a law-governed democracy. The specification of legal terms and conditions for the admissibility of personal data processing is an expression of formal and material guarantees of individual personal information autonomy protection. Maintaining these guarantees is indicative of the legality of data administrators’ activities in the local government administration sector, specifically with regard to the universality of personal data processing in the performance of statutory tasks.
