Summary/Abstract: The paper presents the impact of the repeal of the two codes, namely the Romanian Civil Code and the Romanian Civil Procedure Code, in matter of judicial declaration of death of a person. The major change in the Romanian law aimed at abandoning the institution of a disappeared person as mandatory procedure and self-contained, pre-opening of proceedings for a declaration of death of that person in court. Relatively contrary to our internal regulations are conducted throughout the declarative death in the Czech legal system.
