Particularităţi ale obligaţiei de garanţie a vânzătorului în contractul de vânzare-cumpărare spaniol

Summary/Abstract: The study analyses the main features of the seller's guarantee obligation from the perspective of Spanish legislation and Spanish doctrine in matter of the contract of sale (in particularly the Spanish Civil Code) and the Spanish doctrine. Theoretical and practical approach aims to highlight three specific facets of the obligation of guarantee: guarantee for eviction, guarantee for latent defects, guarantee for hidden tasks. The study reveals practical implications of the latent defects for the buildings (acoustic contamination) and for the sale of animals.
