Summary/Abstract: This article addresses an extremely important issue for the entire „Western” world’s prejudices, namely if there is any human rights protection in the Islamic world and if so, to what extend. The predominance of fundamentalist picture in present day media has clouded a millenaries culture and its several alternative – if not competitive – approaches to the questions of individual’s freedom as well as its relations to the society around. Here, I present the cleavages between various performers of legal interpretation in Islamic law, some principles of this law as well as the two main declarations of human rights: The Arab Chart and the Cairo Declaration – in terms of sources and provisions. The conclusion – acting also as a spine for the entire text – is that the Islamic world is not “behind” the Western one, but even more profound, more complex, perhaps hermetic for the supporters of the exclusive rationality in legal matters.
