Summary/Abstract: So, if a arrest warrant is emitted by the Romanian authorities for a person accused of a corruption offence committed in the private sector (for example, a private officer taking bribery) the warrant could not be executed by the German authorities even if the defendant is on German territory because according with the German penal law, corruption is possible only in the public sector. In this case, the Romanian authorities will have to inform the Court of Justice of the European Communities (Bruxelles). In the same way is the art. III 369 from the European Constitution
