Summary/Abstract: Awarding entity is a person that prepares and conducts the public procurement procedure, then orders the contractor and performs certain activities during its execution. It may take the status of a public entity or a private entity. However, the public or private status of a particular awarding entity is not governed by the provisions of public procurement law, but certain premises (legal norms and social and factual relations) existing outside the public procurement law regime. The article indicates and analyzes the grounds for qualifying a given public entity to the category of contracting authorities under public procurement law, in the context of the case law of the Court of Justice of the European Union and judgments of Polish Administrative Courts.
