Summary/Abstract: The article concerns the sale of renewable energy produced by a municipal company. In this area several regulatory areas were analysed. First, it was justified that the municipality could produce renewable energy in the form of a municipal company. This activity is outside the scope of public utility tasks, but is justified by the law on municipal economy. Secondly, it was pointed out that the production and sale of renewable energy was, in principle, subject to the rules laid down in the Renewable Energy Act. This proves that, in principle, the modes of sale of renewable energy are determined by the mentioned law. The provisions of the Public Procurement Law Act are applied in the second place. Thirdly, attention was paid when and under what conditions the municipal company was obliged to conduct a public procurement procedure for the sale of renewable energy.
