Summary/Abstract: Family law institutions should be always analized with care taking into account that the political, social and religious conceptions which have so much to do with their developing, differ themselves in each period of time. The marriage as well as the chidren born in the marriage set out questions of interest either in the Rome epoch or nowadays. The solutions given by jurists and the ones provided by the emperors confirm the arisen problems caused by the determination of paternity.
