Summary/Abstract: Introduction: Following article is focusing the treatment of older people, whom personal freedom was limited by imprisonment sentence. Convicted persons of retirement age face not only the traps of the environment in which they find themselves suddenly, so called “prisonisation”, but also traps of own old age. The way the older individual adapts to the conditions of imprisonment depends on the quality of penitentiary treatment services and subsequent saturation of their specific needs. Goal: The main aim of this article is to throw the light to the current situation of the penitentiary treatment of persons in retirement age, as well as to point out the positive experience abroad. Findings: The legislation of the Slovak Republic does not define any special treatment of convicted seniors. An elderly person has to face not only the dangers of the old age but also the environment in which he found himself. The only way to eliminate these negative phenomena is to develop a treatment plan for the convicted, tailored to their specific needs. The most important element in the process of adaptation of the convicted senior is the entry process. The positive adaptation of the convicted seniors is also affected by their pension, what allows them to have a better social position comparing to the other convicts who participate in the regular work duty. Conclusion: Our findings point to legislative gaps in the treatment of convicted seniors. In particular, there is no specification of treatment to meet the individual needs of seniors in relation to their age and health.
