Summary/Abstract: The separated guaranty contract can be defined as an abstract transaction because the causal element is not manifested in its structure. In this context, at the time, the guarantee is requested, there may be a lack of cause to justify it, and for that reason a prior control of its existence is necessary. The guarantor's protection can be done by exception doli generalis as a preventive measure against unjust enrichment.
