Summary/Abstract: The civil liability of judges and prosecutors has been a major issue under the current legislative framework. The controversies focused in particular on the accountability procedure and on the mechanism for exercising the right to regress of the state against the magistrate, given that what was alleged against the system in force was the inefficiency and low incidence of the action in regress. In this context, it is natural that the legislator's intervention in this matter should be the subject of critical analysis, manifested by objections of unconstitutionality, by statutes of the constitutional court and, last but not least, by doctrinal interventions.
