On the Fourth Opinion of the Advisory Committee regarding Romania’s implementation of the Framework Convention for the Protection of National Minorities

Summary/Abstract: The article discusses the manner in which Romania complies with its commitments regarding the respect for the rights of national minorities. First I summarize the last Opinion of the Council of Europe and then I describe several cases in the national jurisprudence concerned with the rights of national minorities. I show that, while Romania has an adequate legislation regarding the rights of national minorities, it is often violated with the help of the national courts. The courts either ignore international conventions that Romania has signed and ratified or purposely misinterpret the national legislation in a manner unfavorable to national minorities. The efforts of national authorities are not generally directed toward a good-faith implementation of the provisions of the Framework Convention but instead toward finding legislative means of restricting the rights of national minorities.
