Summary/Abstract: Exactly like its predecessor, the current romanian Civil Code has a definition of the contract (article 1166). Together with the unchalenged elements of continuity and even normativ progress, there are also some issues that are questionable and open for discussion from a logical and legal point of view. On this it can be exemplified with article 1166 Civil Code that refers to "individuals" and to "their intention" to constitute, modify or terminate a judicial report at ther own will.
