Summary/Abstract: In this paper, the author analyzesthe legal foundations and framework of ethnicitybased non-territorial autonomy in international, comparative and domestic law. The non-territorial autonomy (NTA)is considered to be an appropriate institutional solution for ensuring minority participation in public affairs even though international law does not provide clear guidelinesfor its establishment. After analyzing the comparative law and the national legalsolutions on thisissue, the author concludes that the cultural autonomy is a constitutionally acceptable NTA framework, while ethnicity-based functional autonomy hassignificant constitutional limitations and inherent antinomy.
