Some particular issues concerning the calculation of length of service and seniority for the graduates the educational institutions of the Ministry of Internal Affaires

Summary/Abstract: The right to recognition of length of service, seniority at work and in the profession are economic and social rights, set out by all the relevant international legislation on the legal protection of human rights to which Romania is party and also by the internal legislation on the matter, being recognized for all citizens, thus including the personnel from the system of public order and national security. Regarding the concept of "gradation", it is part of the base salary which, according to art. 9 paragraph. 1 of O.G. no. 38/2003 shall be granted based on the time served as a policeman. The seniority bonus and the duration of the annual leave shall be granted, respectivel are amended, for civil servants, with or without special status, also in relation to the length of service recognised. We consider that in calculating the length of service for police officers coming of the graduates of the Police Academy "Alexandru Ioan Cuza", the period during wich they had the status of a student in the study programs specializing in "Law" and "Public order and safety", mandatory attendance courses, must be taken into account in determining the length of service and the granting of the salary gradations, bonuses and other rights, salary related or not, the granting of which is conditional upon of a legal lenghth of service.
