Summary/Abstract: Rights covered by the ancillary penalty provided for in Article 71 Penal Code are not absolute. They may be subject to limitations, and the state has a margin of appreciation in this regard. European Court of Human Rights has reaffirmed that this margin is wide but not comprehensive. Member States have many ways to shape their own democratic vision and there are lot of differences, influenced, inter alia, by historical development, cultural and political diversity across Europe.
