Summary/Abstract: The topic of this work is the recent judgement of International Criminal Tribunal in The Hague rendered to Croatian generals Gotovina and Markač and its deficiencies, but primarily from the aspect of the type of criminal procedure that enabled such kind of (wrong) decision. From the other side, it points out that our system of criminal procedure tends just toward such type of proceedings. There is the question whether those changes are justified and whether it could lead us to the judgements in our courts of Gotovina and Markač’s Judgement quality. The positive answer has been given which directs us to energetic turn in the way our criminal procedure legislation and practice are going to. At the same time that would be one of the answers to such judgement of the Tribunal in The Hague with clear message that it is possible to learn a much on the negative experiences and react to it accordingly. It is possible that such answer could gain a very broad publicity.
