Judicial Review: A Critical Commentary on the new Legal Solutions

Summary/Abstract: In this paper, the author provides an overview and a critical commentary on some legal solutions concerning the judicial review and analyzes some decisions of the Serbian Supreme Court of Cassation dealing with this legal remedy. The author focuses on the possibility of filing claims for judicial review in disputes on non-proprietary matters, the parties who may file a claim for judicial review and the rules on the obligatory legal representation in these proceedings. The author also looks into the new legal solutions governing the reasons for filing a claim for judicial review and elaborates on the subsidiary form of judicial review which implies subject-specific reasons for filing a claim for judicial review.
