Summary/Abstract: The goal of the article is to discuss the main interpretation problems concerning a new institution of substantive criminal law contained in art. 59a of Criminal Code, introduced into Polish law system by the Act from September 27th 2013 (Dz. U. 2013, item 1247, as amended) as amended by the Act from February 20th 2015 (Dz. U. 2015, item 396).
