Summary/Abstract: Considerations included in this article relates to the new institution of substantive criminal law contained in art. 59a of Criminal Code, known as „compensatory discontinuation”, introduced into Polish law system by the Act from September 27th 2013 (Dz. U. 2013, item 1247, as amended) as amended by the Act from February 20th 2015 (Dz. U. 2015, item 396). The article raises problems with interpretation concerning art. 59a of Criminal Code along with presentation of critical comments to the solution provided in that provision. Author also gives an answers to the questions raised during 3rd Cracow Penal Forum.
