Summary/Abstract: The article aims to discuss the most controversial issues concerning a new institution, the so-called compensatory discontinuation of criminal proceedings upon harmed party's motion, described in art. 59a of Criminal Code, which was introduced into Polish law system by the Act from September 27th 2013 (Dz. U. 2013, item 1247, as amended) as amended by the Act from February 20th 2015 (Dz. U. 2015, item 396). Author interprets art. 59a of Criminal Code in response to the questions raised during 3rd Cracow Penal Forum.
