Article 167 of the Code of Criminal Procedure after the amendment – preliminary outline of problems

Summary/Abstract: A thorough amendment of the Code of Criminal Procedure introduced by the Act from September 27th 2013 (Dz. U. 2013, item 1247, as amended) as amended by the Act from February 20th 2015 (Dz. U. 2015, item 396) included also the provision of art. 167 § 1 of Code of Criminal Procedure. Author presents a comprehensive interpretation of new regulations and seeks to resolve questions concerning interpretation that arise in the course of the analysis. The author also draws attention to the practical aspects of the entry into force of the amended art. 167 § 1 of Code of Criminal Procedure.
