Commentary to the Supreme Court decision of 25 June 2015, II KK 171/15

Summary/Abstract: Przedmiotem glosy jest stanowisko Sądu Najwyższego wyrażone w wyroku z dnia 25 czerwca 2015 r., II KK 171/15, w zakresie zawartego w nim rozstrzygnięcia dotyczącego obowiązku naprawienia szkody na podstawie art. 46 k.k., w przypadku częściowego jej naprawienia. W publikacji rozważono zakres pojęcia szkody, dochodząc do wniosku, iż obejmuje on zarówno stratę (damnum emergens) jak i utracone korzyści (lucrum cessans). Ponadto, w glosie wyrażony został pogląd, iż sąd orzekając obowiązek naprawienia szkody powinien wziąć po uwagę rozmiary naprawionej szkody. Autorka, co do zasady, zgadza się ze stanowiskiem Sądu Najwyższego, ale zwraca uwagę na konieczność ustalenia – w każdym analogicznym stanie faktycznym – aktualnej i rzeczywistej wartości odzyskanego mienia. The commentary discusses the Supreme Court opinion expressed in decision of 25 June 2015, II KK 171/15, regarding the obligation to redress damage on the basis of Article 46 of the Polish Criminal Code in case in which the damage was partially compensated. In the publication the analysis of the concept of damage was presented, indicating that it refers to damage actually suffered (damnum emergens) and also to lost profits (lucrum cessans). Furthermore, in accordance to the author’s opinion, when the court decides to impose the obligation to redress damage, all circumstances of the case, especially the extend of the damage already compensated, have to be taken into account. In general, author agrees with the opinion of the Supreme Court expressed in the commented decision, but she points out that, in similar cases, it is necessary to determine the actual, real value of recovered property.
