Summary/Abstract: This paper argues, drawing a parallel with the case-law from other states, that the courts from the Republic of Moldova have a positive obligation to recognise, when appropriate, some judgments delivered by the unrecognised and illegal courts of de facto entities, especially by the courts from Transnistria. This obligation is imposed by the European Court of Human Rights and it is based on the Namibia exception. Moreover, there may be situations in which the effective protection of human rights demands a collaboration between the authorities of the Republic of Moldova and the unrecognised and illegal authorities of Transnistria.
