DNA database in Poland (remarks on its functioning)

Summary/Abstract: Przedmiotem artykułu są wybrane, najbardziej kontrowersyjne kwestie związane z funkcjonowaniem bazy danych DNA w Polsce. Niniejsze opracowanie jest próbą dokonania analizy statystycznej oraz prawnej powyższego zagadnienia. Zawiera propozycje rozwiązań legislacyjnych dotyczących art. 21d ustawy o Policji. Dotyka także problematyki wykorzystania innowacyjnych metod śledczych, w tym tzw. familial searching. Artykuł jest skierowany w głównej mierze do praktyków, którzy na co dzień stykają się z problemem wykrywania przestępstw oraz ich sprawców. The subject of this article are selected and most controversial matters related to functioning of the DNA database in Poland. This study is an attempt in statistical and legal analysis of the above-mentioned issue. Study also contains proposals for legislative solutions concerning Art. 21d of Act on the Police. Article also raises issues concerning the usage of innovative investigation methods, such as so-called familial searching. This study is addressed primarily to law enforcement authorities who on a daily basis are confronted with the problem of detection of crimes and their perpetrators.
