Międzynarodowy standard statusu i organizacji prokuratury a najnowsze zmiany polskiego porządku prawnego
The international standard concerning status and organisation of public prosecution office and recent changes in Polish legal system

Summary/Abstract: Opracowanie prezentuje standardy przyjęte przez ONZ i Radę Europy, jakim powinna odpowiadać prokuratura w demokratycznym państwie prawa. Analizie poddane zostały dwa zagadnienia poruszane przez międzynarodowe akty prawne poświęcone prokuraturze: niezależność prokuratury i prokuratorów, czyli niezależność zewnętrzna i wewnętrzna, oraz zasady zatrudniania, awansu i odpowiedzialności prokuratorów. Standardy te zostały porównane z najnowszą polską ustawą regulującą organizację prokuratury: Prawem o prokuraturze z 2016 r., a także z wdrożoną po jej wejściu w życie przez Prokuratora Generalnego polityką kadrową w prokuraturze. Artykuł wskazuje jednoznacznie, że w wielu punktach najnowsza regulacja nie spełnia wymogów międzynarodowych, choć były one realizowane przez poprzednią ustawę. The paper presents standards adopted by the UN and Council of Europe concerning the organization of public prosecution office in democratic society. The analysis focuses on two issues mentioned in international acts on prosecution: the independence of prosecution and prosecutors, that means the external and internal independence, and the rules of recruitment, career management and accountability of prosecutors. These standards are compared with the newest Polish Law on Prosecution from 2016, as well as with the human resources politics introduced by the Public Prosecutor-General after enactment of the abovementioned Law. Unfortunately, the conclusions show clearly that the new Polish regulation does not meet the international standards in many points, though they were met by the previous Law.
