Procedural aspects of the so-called conviction without a hearing after the entry into force of the amendment of 11 March 2016.

Summary/Abstract: Tematem artykułu jest omówienie proceduralnych aspektów trybów konsensualnych uregulowanych w art. 335 k.p.k., funkcjonujących od 15 kwietnia 2016 r. (Dz.U. 2016, poz. 437). Dogmatycznej analizie poddano kwestie związane z treścią skargi, udziałem pokrzywdzonego w postępowaniu czy też odpowiednim stosowaniem działu 40 Kodeksu postępowania karnego. Obecnie obowiązującej regulacji nie sposób ocenić pozytywnie. Główne zarzuty stawiane pod jej adresem to wydłużenie postępowania, nieodpowiednia regulacja pozycji procesowej pokrzywdzonego oraz nadmierny formalizm związany z wnoszeniem oskarżeń do sądu. The topic of the article is to discuss the procedural aspects of consensual modes regulated in art. 335 k.p.k., operating from April 15, 2016 (Journal of Laws 2016, item 437). Dogmatic analysis covered issues related to the content of the complaint, participation of the aggrieved party in the proceedings or appropriate application of Section 40 of the Code of Criminal Procedure. The currently applicable regulation can not be evaluated positively. The main accusations against her are prolonging the proceedings, inadequate regulation of the victim's trial position and excessive formalism related to bringing charges to the court.
