Plea agreements in the practice of the ad hoc tribunals (critical remarks)

Summary/Abstract: Celem artykułu jest krytyczne spojrzenie na funkcjonowanie porozumień procesowych (plea agreements) w postępowaniach przed Międzynarodowymi Trybunałami Karnymi dla byłej Jugosławii oraz dla Rwandy. Rozważania dotyczące postanowień plea agreements przedłożonych trybunałom: jugosłowiańskiemu i rwandyjskiemu zostały poprzedzone wprowadzeniem dotyczącym modeli plea bargaining w prawie amerykańskim oraz procedury w razie przyznania do winy przyjętej w Regułach Procesowych i Dowodowych obu Trybunałów. The aim of this work is to present critical remarks regarding plea agreements at the International Criminal Tribunals for the former Yugoslavia (ICTY) and for Rwanda (ICTR). The author starts her work with the introduction concerning the models of plea bargaining in the United States and sketches the plea procedure at the ICTY and ICTR according to the Rules of Procedure and Evidence adopted by both of Tribunals. Then, the author explains the provisions of the plea agreements at the ICTY and ICTR.
